Professional services agreement
This agreement is between fxed and you, an independent trade professional (or a company registering its staff), and covers your use of the platform to receive and complete jobs.

1. Parties
This agreement is between [TO CONFIRM: registered company name] (company no. [TO CONFIRM: company number], [TO CONFIRM: registered address]) and you, the pro named on your fxed account. Where a company registers staff, the company is a party and is responsible for each person it registers.
2. Your status: self-employed, not an employee
- You are an independent contractor in business on your own account. This is not a contract of employment or a worker's contract, and nothing here creates a partnership or agency beyond payment collection.
- You decide whether, when and where to work. There is no obligation to accept any job and no obligation on us to offer any.
- You may work for other platforms and take your own private customers.
- You may send a suitably qualified substitute only where the app supports it and the substitute is separately approved by us.
- You are responsible for your own income tax, National Insurance and, where applicable, VAT and CIS. We do not deduct tax from your payouts.
- You provide your own tools, vehicle, materials and phone.

3. Eligibility and compliance
- Valid right to work in the UK, and photo ID verified by us.
- A full, valid UK driving licence.
- Current trade qualifications for each trade you enable, plus Gas Safe or NICEIC registration where the work requires it.
- Public liability insurance of at least [TO CONFIRM: minimum cover], and any required professional indemnity or motor insurance for business use.
- You must keep every document in date. When a document expires you are automatically taken offline and removed from dispatch until it is renewed and re-verified.
- You must tell us within [TO CONFIRM: notification window] of any conviction, caution, insurance lapse, licence restriction or regulatory action.
4. Jobs, acceptance and completion
- Jobs are offered to nearby available pros in turn. Offers expire quickly; declining is free of penalty, but persistent no-shows after acceptance are not.
- Once accepted, you must travel promptly, keep location sharing on so the customer can track you, and keep the app updated at each stage.
- Record scope, extra time, parts and photos in the app. Variations must be approved by the customer in the app before the work is done.
- Complete lone-worker safety check-ins when prompted.
5. Commission, payment and payouts
- The customer pays fxed. We deduct commission of 25% from the job total and pay you the balance.
- Payouts run weekly, covering completed jobs up to the previous Sunday, to the bank account on your account, with a statement showing every job, deduction and tip.
- Tips are yours in full, with no commission deducted.
- We may withhold or recover amounts relating to refunds, chargebacks, customer compensation or fraud, and will explain any deduction on your statement.
- Commission rates may change on [TO CONFIRM: notice period] notice. If you don't accept the change you may stop using the platform.
6. Conduct and customer property
- Be professional, punctual and presentable, and identify yourself on arrival.
- Never ask a customer to pay off-platform, in cash, or to cancel and rebook privately.
- Never solicit a platform customer for the same job outside fxed.
- Do not smoke, consume alcohol or use drugs at a customer's property, and never attend impaired.
- Treat customer data confidentially: access notes, alarm codes and addresses are for the job only and must not be kept or shared.
- Do not bring unauthorised people to a job.
7. Quality, ratings and the work itself
The work contract is between you and the customer under the customer–pro terms, and you are responsible for the quality of your workmanship, including returning to remedy defective work within the guarantee period. Ratings and complaints are reviewed by our team, and a human will review any decision that affects your account if you ask.
8. Suspension and termination
- Either party may end this agreement at any time on [TO CONFIRM: notice period] notice. Any accepted job must still be completed or safely handed over.
- We may suspend you immediately for safety risks, expired compliance documents, suspected fraud, off-platform soliciting, or serious customer harm.
- On termination we pay everything properly owed on the next payout run, and retain records as set out in the privacy notice.
9. Liability and indemnity
You indemnify us against claims arising from your work, your negligence, your failure to hold required insurance or qualifications, or your breach of this agreement, up to [TO CONFIRM: indemnity cap, if any]. Our liability to you is limited to [TO CONFIRM: liability cap, e.g. commission-inclusive fees for the affected jobs], except where liability cannot lawfully be limited.
10. Data and law
We handle your personal data as described in the privacy notice. You act as a controller for any customer data you retain outside the app, which you should keep to the minimum. This agreement is governed by the laws of England and Wales.
11. Acceptance
You accept this agreement when you submit your application in the fxed pro sign-up. We record the version and the date and time of acceptance on your account.
